Terms of Service

Effective date: October 31, 2026
Last updated: October 31, 2026

These Terms of Service ("Terms") are an agreement between you and Aurevia Ventures LLC, a Delaware limited liability company (formerly named BuilderBoard Technologies LLC), which operates GAMIFAI ("GAMIFAI," "we," "us"). They cover your use of the GAMIFAI website at gamifai.app and the GAMIFAI service (together, the "Service").

By creating an account or using the Service, you agree to these Terms. Section 14 contains an agreement to resolve disputes by individual arbitration and waives class actions and jury trials, unless you opt out within 30 days. If you use the Service for a company, school or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information. It is part of these Terms.

1. What GAMIFAI does

GAMIFAI turns training and educational material into playable browser games.

  • Creators (trainers, teachers, companies) upload source material, such as PDFs. Our AI tools draft a course from it: learning objectives, short lessons and questions, each with page citations. Creators review, edit and publish the course.
  • Learners join a published course by link or join code and play it in one of several modes, such as Adventure, Arcade, Basketball, or Simple mode (no game layer). Answers are graded on our servers. Creators can see their learners' results and export them.

We may change, add or remove features over time. If we remove a major feature from a paid plan during your paid term, we will tell you in advance, and you may cancel and receive a pro-rated refund for the unused part of the term.

2. Accounts

  • Age. You must be at least 18 to create a creator account or buy a plan. Learners who sign up on their own must be at least 13. Children under 13 may use the Service only through a school that has a signed data agreement with us (see Section 9).
  • Accurate information. Give us accurate account information and keep it up to date.
  • Security. Keep your password confidential. You are responsible for activity under your account. Tell us promptly at hello@gamifai.app if you think your account has been compromised.
  • Workspaces and roles. Accounts belong to a workspace with roles such as owner, creator or learner. A workspace's owners control it, including who can see learner results, and may remove members.

3. Plans, billing, automatic renewal and cancellation

3.1 Plans

Current plans, prices and limits are listed on our pricing page. If that page differs from this summary, the pricing page controls.

Plan Who it's for Billing
Free Play Anyone trying the Service Free
Classroom An individual teacher Yearly
School Schools, priced per teacher (minimum 10 teachers) By agreement
Team Companies Monthly or yearly

Free Play lets you build and preview one game. It does not include sharing with learners. We may change Free Play limits.

3.2 Payment

Paid plans are billed in advance through our payment processor, Stripe. We never see or store your full card number. When you subscribe, you authorize us, through Stripe, to charge your payment method for your plan, plus any applicable taxes, at the start of each billing term. Schools may pay by invoice under a separate order form; if an order form conflicts with these Terms, the order form controls for that purchase.

3.3 Automatic renewal

Paid plans renew automatically until you cancel. Each plan renews for the same length as your current term: yearly plans every year and monthly plans every month. At each renewal we charge the payment method on file the plan's price at that time, plus applicable taxes. Before you subscribe, we show you the price, how often you will be charged, and how to cancel, and we ask you to agree to automatic renewal.

After you subscribe, we will email you a confirmation with your plan, price, renewal terms and how to cancel. For yearly plans, we will also email you a reminder 15 to 45 days before each renewal showing the amount and how to cancel. Monthly subscribers will get a reminder of their subscription terms at least once a year.

3.4 How to cancel

You can cancel online at any time. Go to Plan in your account (gamifai.app/app/billing) and choose Cancel plan. Cancellation is immediate, with no phone call or email needed. You can also email hello@gamifai.app and we will cancel for you.

Cancellation takes effect at the end of your current paid term. You keep your paid features until then and will not be charged again. When the term ends, your workspace moves to Free Play: your courses and results stay in your account, but sharing with learners stops.

3.5 Price changes and other changes to your plan

If we raise the price of your plan, we will email you between 7 and 30 days before the new price takes effect, with how to cancel. The new price applies from your next renewal. We will also tell you about any other material change to your plan's terms before it takes effect.

3.6 Refunds

Payments are non-refundable, and we do not give refunds or credits for partial terms, except where required by law, where these Terms say otherwise (Sections 1 and 10), or where we decide to at our discretion. If you think you were charged by mistake, email hello@gamifai.app.

3.7 Failed payments

If a renewal payment fails, Stripe will retry it for up to two weeks. During that time we may pause sharing and paid features until payment succeeds. If payment still fails, your subscription ends and your workspace moves to Free Play.

3.8 Practice tokens

Practice tokens are an optional add-on that pays for AI practice, such as Simulation roleplays (one token per session). Token packs are one-time purchases: they do not renew, and tokens do not expire while your account is open. Tokens have no cash value, can't be transferred to another workspace, and are non-refundable except where required by law or if we discontinue the feature. Every workspace receives a few free starter tokens. AI practice is coaching only: it does not change scores or mastery and is not an assessment or certification.

3.9 Give a Classroom

For every paid Classroom plan, we intend to give a free Classroom plan to a teacher at a Title I school, starting in California. This is GAMIFAI's own program, funded by us. Your purchase is not a charitable donation by you and is not tax-deductible. We decide how the program runs, including which teachers receive plans, and we may change or end it.

4. Your content

4.1 You keep ownership

"Your Content" means anything you or your learners upload, enter or create in the Service, including source documents, text extracted from them, courses, and learner answers. We do not claim ownership of Your Content. As between you and us, you (or your organization or licensors) own it. Course material generated for you in the Service is part of Your Content.

4.2 The license you give us

You let us host, store, copy, process, display and transmit Your Content only as needed to provide, secure and support the Service for you. This includes extracting text from documents you upload, sending source text and course content to our AI providers so they can draft or edit course material for you (see Section 5 and the Privacy Policy), and showing published courses to the learners you share them with. This license ends when Your Content is deleted, except for backup copies that are overwritten within 30 days.

We may use aggregated, de-identified information about how the Service is used (for example, which game modes are played most) to improve it. We do not use Your Content to train AI models, and we never use student information for any non-educational purpose.

4.3 Your responsibility for what you upload

You confirm that:

  • you own Your Content or have the rights and permissions needed to upload it and let us process it as these Terms describe, including any textbooks, manuals or other third-party material;
  • Your Content does not violate anyone's rights or any law; and
  • you have removed other people's personal information (such as names, contact details, ID numbers, or health or financial information about real people) from source documents before uploading, unless including it is lawful and necessary for your course.

4.4 Copyright complaints

If you believe something on the Service infringes your copyright, email hello@gamifai.app with: your contact information; a description of the work; where the material appears on the Service; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove infringing material and may close the accounts of repeat infringers.

5. AI-generated content

The Service uses third-party AI models (currently Anthropic's Claude) to draft and edit course material.

  • AI output can be wrong. AI-drafted objectives, lessons, questions, answers and citations may be inaccurate or incomplete, or may misstate your source material.
  • You review before publishing. Creators are responsible for reviewing, correcting and approving content before publishing it. Nothing drafted by AI reaches learners until a creator publishes it.
  • Not professional advice. Content in the Service is educational material, not legal, medical, financial, safety or other professional advice.
  • Usage policies. You may not use the Service to generate content that our AI providers' usage policies prohibit.

6. Not a substitute for required training or certification

GAMIFAI is a training aid. It does not replace legally required training, licensing, continuing education or certification.

Completing a GAMIFAI course, earning XP or reaching "mastery" does not mean anyone is licensed, certified, qualified or compliant with any law, regulator, licensing board or employer requirement. GAMIFAI courses are not approved by any regulator or accrediting body unless we have agreed otherwise in writing. If you use the Service for compliance, safety or licensing topics, you remain responsible for completing all required training through approved means.

7. Acceptable use

You may not, and may not let anyone else:

  1. upload or share anything illegal, or anything that infringes intellectual property, privacy or other rights;
  2. upload malware, or probe, scan, disrupt, overload or try to break into the Service or other users' data;
  3. harass, threaten, bully, defame or discriminate against anyone, or share sexually explicit, violent or hateful content;
  4. upload sensitive personal information (such as health, financial or government ID information) about anyone;
  5. use the Service to collect personal information from learners beyond what it is designed to collect;
  6. impersonate anyone or misrepresent your affiliation;
  7. get around plan limits, grading or security controls, or tamper with scores or results;
  8. scrape, copy or reverse engineer the Service, or use it to build a competing product, except as the law allows; or
  9. resell or sublicense the Service without our written permission.

We may remove content or restrict access that we reasonably believe violates these Terms.

8. Our rights

The Service, including our software, game designs, themes, artwork, sound and branding, belongs to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send us feedback or ideas, we may use them without any obligation to you.

9. Schools and students

This section applies when a school, district or other educational institution (a "School"), or a teacher acting for one, uses the Service with students.

  • The School controls student information. We process student information on the School's behalf, only to provide the Service for the School's educational purposes, under the School's direction. Under FERPA, we act as a "school official" with a legitimate educational interest.
  • California student privacy law. We follow California's Student Online Personal Information Protection Act (SOPIPA): we do not show targeted advertising to students, build profiles of students except for school purposes, or sell student information, and we delete a student's information when the School asks. Our agreements with California schools include the terms required by California Education Code section 49073.1.
  • Consents and notices. The School is responsible for any consent or notice required by law (including COPPA for students under 13, FERPA and state student-privacy laws) and for deciding what student information is entered.
  • Students under 13. Use with students under 13 requires a signed data privacy agreement between the School and us. Contact hello@gamifai.app.
  • Teachers. A teacher who buys a Classroom plan and uses it with students confirms that their School allows them to do so. Without a signed School agreement, Classroom plans may be used only with students 13 and older.
  • Signed agreements control. If a signed data privacy agreement with a School conflicts with these Terms on student information, the signed agreement controls.

10. Ending your use of the Service

  • By you. You may stop using the Service and cancel your plan at any time (Section 3.4). You can delete your account at any time under Account → Delete account (or email hello@gamifai.app).
  • By us. We may suspend or end your access if you materially breach these Terms, fail to pay, create risk or legal exposure for us or others, or if the law requires it. Where reasonable, we will give you notice and a chance to fix the problem first.
  • If we discontinue the Service, we will give you at least 30 days' notice and refund prepaid fees for the unused part of your term.
  • After your account ends, you will have 30 days to export your data (for example, learner results as CSV). After that we delete Your Content as described in the Privacy Policy.
  • Sections that by their nature should continue (including 4.3, 5, 6 and 11 to 15) continue after your use ends.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure, that AI-generated content will be accurate, or that using the Service will achieve any learning, training or compliance result. Some states do not allow these disclaimers, so some may not apply to you.

12. Limitation of liability

To the fullest extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and
  • our total liability for all claims about the Service or these Terms is limited to the greater of (a) what you paid us for the Service in the 12 months before the event that led to the claim, or (b) US $100.

These limits do not apply to liability that cannot be limited by law, including liability for fraud, gross negligence or willful misconduct. Some states do not allow these limits, so they may not fully apply to you.

13. Indemnity

If you use the Service for a business or organization, you will defend and indemnify Aurevia Ventures LLC and its members, officers, employees and agents against third-party claims, losses and costs (including reasonable attorneys' fees) arising from Your Content, your breach of these Terms, or your violation of law. This section applies to public schools and government entities only to the extent their governing law permits.

14. Disputes, arbitration and governing law

Please read this section carefully. It requires most disputes to be resolved by individual arbitration instead of in court, and it waives class actions and jury trials. You can opt out within 30 days (Section 14.7).

14.1 Talk to us first

Before starting an arbitration or court case, the party with the claim must send the other a written notice describing the claim, the facts behind it and the relief requested, and the two sides must try in good faith to resolve it for 60 days. Send notices to hello@gamifai.app or PO Box 51301, Palo Alto, CA 94303. We will send ours to the email on your account. Time limits for bringing claims are paused during these 60 days.

14.2 Agreement to arbitrate

If we can't resolve a dispute informally, you and we agree to resolve any dispute arising out of or relating to these Terms or the Service by binding individual arbitration, except as stated in Section 14.3. The Federal Arbitration Act governs this section.

  • Who runs it. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules (or its Comprehensive Arbitration Rules for claims over $250,000) and, for consumers, its Consumer Arbitration Minimum Standards, available at jamsadr.com. If JAMS is unavailable, the parties will choose another administrator, or a court will appoint one.
  • Costs. If you are a consumer, you pay no more than the consumer filing fee JAMS's minimum standards allow, and we pay all other JAMS and arbitrator fees. Each side pays its own lawyers unless the arbitrator awards fees under applicable law.
  • Where and how. Arbitration takes place by video or phone, or in person in the county where you live. Claims of $25,000 or less may be decided on written submissions unless the arbitrator decides a hearing is needed.
  • The arbitrator's power. The arbitrator can award the same individual relief a court could, including damages, and any remedy available to you under the consumer protection laws of your state. The arbitrator's decision is final and can be entered as a judgment in any court with jurisdiction.

14.3 What is not arbitrated

  • Small claims. Either party may take a claim to small claims court instead, if it qualifies there.
  • Intellectual property and misuse. Either party may go to court to stop infringement or misuse of its intellectual property or unauthorized access to the Service.
  • Public injunctive relief. A request for public injunctive relief (relief meant to protect the general public under laws such as California's consumer protection statutes) will be decided by a court, not an arbitrator, after any arbitrable claims are decided. The court case will be paused until the arbitration ends.
  • Schools and public entities. This Section 14 does not apply to public schools, school districts or other government entities.

14.4 No class actions or jury trials

You and we may bring claims against each other only individually, not as a plaintiff or class member in any class, collective or representative action. The arbitrator may not combine more than one person's claims or preside over any form of class or representative proceeding. You and we each waive the right to a jury trial. If this class waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court and not in arbitration, and this section will not allow class arbitration.

14.5 Many similar claims at once

If 25 or more similar claims are filed against us or by us with the help of the same or coordinated lawyers, they will be handled under JAMS's Mass Arbitration Procedures. Where those procedures allow, the claims will be arbitrated in batches, starting with a small number of test cases, while the rest wait their turn. Time limits for the waiting claims stay paused. A court may enforce this section, and nothing in it limits any party's right to an individual decision on their own claim.

14.6 Who decides arbitrability

A court, not an arbitrator, decides whether Sections 14.4 and 14.5 are valid and enforceable and how they apply. The arbitrator decides all other questions about the scope or enforceability of this agreement to arbitrate.

14.7 Your right to opt out

You can opt out of this agreement to arbitrate within 30 days after you first accept these Terms. Email hello@gamifai.app from your account email, or write to PO Box 51301, Palo Alto, CA 94303, with your name, account email and a statement that you opt out of arbitration. Opting out doesn't affect anything else in these Terms or your use of the Service. Disputes will then be resolved in court under Section 14.9.

14.8 Changes to this section

If we make a material change to this Section 14, you may reject it by emailing us within 30 days after we notify you. Rejecting a change means the previous version of this section continues to apply to you. A change never applies to a claim you notified us about before the change took effect.

14.9 Governing law and courts

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, and by the Federal Arbitration Act for this Section 14. This does not take away any protection you have under the consumer protection laws of the state where you live (for California residents, including California's automatic renewal and consumer privacy laws) that cannot be waived by agreement. Any dispute that is not arbitrated will be decided in the state or federal courts in Santa Clara County, California, and both parties consent to jurisdiction there. If you are a consumer, you may instead bring a court claim in the county where you live.

15. General

  • Changes to these Terms. We may update these Terms. If a change is material, we will tell you by email or in the Service at least 30 days before it takes effect. If you do not agree, you may cancel before then, and we will refund prepaid fees for the unused part of your term. Continuing to use the Service after that date means you accept the updated Terms.
  • Entire agreement. These Terms, the Privacy Policy and any order form or signed agreement with us are the entire agreement about the Service.
  • Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
  • Severability and waiver. If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver of it.
  • Events beyond our control. We are not liable for delays caused by events beyond our reasonable control.
  • Export and sanctions. You may not use the Service where U.S. export or sanctions laws prohibit it.
  • Notices. We send notices to the email on your account. You can send notices to hello@gamifai.app or by mail to PO Box 51301, Palo Alto, CA 94303.

16. Notice for California consumers
